President's Address
Welcome to the second edition of the MII Ezine.
We have received excellent feedback on the first one – both on its
existence and its content. We would really appreciate any comments,
good or critical, that you have: only in that way can we improve our
service. Improving our service is a theme dealt with to some extent in
this ezine. We believe that it is imperative that the standards and
quality of mediation and of MII Mediators is kept under constant review
and that when using an MII Mediator you are assured of quality of
skills and practice.
We have an Accreditation Policy Committee
whose role it is to recommend to Council the minimum standards required
at the various levels of membership and to suggest how those standards
are kept up to date. We have a Code of Ethics and Practice
which is under review, again with a view to ensuring that when you
employ an MII Mediator you can rely on a consistency of practice. If a
party is dissatisfied with the service of the Mediator we have a
complaints and disciplinary process involving non-Mediators so that we
are not just sitting in judgment of ourselves. All MII Mediators are
also obliged to have appropriate professional indemnity insurance and
to engage in compulsory continual professional education.
With all of these processes in place we believe we can offer you,
uniquely, the confidence of knowing that in using an MII Mediator you
need look no further than to ensure that they have a current practising
certificate... and that you can do in an instant, by going onto our
website www.themii.ie and searching for the Mediator under the Find a Mediator
button which is prominently displayed on the home page. When on the
site you can compare the qualifications and experience of different
Mediators and if you are looking for a Mediator who practices in a
particular area of mediation or in a particular geographical location
you can enter that as a keyword and you will get a selection of
possible Mediators.

Facilitating and Mediating Multi-Party Issues
Nowadays
there is more insistence from people and groups to become involved and
have their say in areas which can directly, and in some cases
indirectly, impinge on them. People are now more aware of their rights
and are increasingly willing to take legal action where they feel
necessary. However, a solution ‘imposed’ by a somewhat
detached third party through legal action is far less likely to meet as
many of the disputants' needs, as solutions agreed between them.

Choosing a Mediator
The
development of standards in mediation is central to the work of the
MII, which has taken a leadership role in ensuring the highest
standards of training, practice and ongoing development of Mediators in
Ireland. In this article, Treasa Kenny, MII Accreditation Director,
outlines the assurance for those seeking an appropriately qualified
Mediator in using an accredited MII Mediator and asks the question: 'Can you afford to engage the services of a Mediator who is not an accredited member of the Mediators’ Institute of Ireland?'

The opportunity to attend a Master Class with Ken Cloke is not one to be missed. In the following article, Anna Doyle, EUROCONTROL recounts the learnings from a two-day Master Class by Ken Cloke in December 2008:

HSCS Launch Internal Mediation Scheme
On
25 June 2009, 36 HSE members received their MII Certified Member status
certificates from Karen Erwin, President of the MII, formally launching
the Health and Social Care Services (HSCS) Internal Mediation
Scheme.

Mediation – 70% Saving Compared to Litigation
According to a survey conducted by the Irish Commercial Mediation Association (ICMA), mediation saves time, money and business relationships.
Findings from a survey sent by ICMA to the Managing Partners of more
than 3,500 Law and Accountancy firms as well as Barristers and other
professionals show that the key advantage of commercial mediation was
in cost savings, respondents stating that their clients could save up
to 70% compared with litigation.

MII Annual Conference 2009: 'A Time to Mediate: Applications in Practice'
The
2009 MII Annual Conference will take place in St Helens Radisson Hotel,
Stillorgan, Dublin on 14th and 15th November. Its theme, ‘A Time to Mediate: Applications in Practice’ will be reflected throughout a series of workshops presented by national and international experts.

MII Web Site Development
The
MII web site continues to attract a high level of traffic with in
excess of 1,700 visits to the site during the month of June.

MII Approval under Section 244 - Gain for UK Members
MII
has been approval under Section 344 of the Income Tax (Earnings &
Pensions) Act 2003 allowing members taxable in the UK to deduct
the cost of annual membership against their income tax.
