Standard of Ethics in Mediation – Aspiration, Ideal or Reality?

To promote discussion among participants in relation to Ethics in Mediation, and by discussion including an exchange of experiences:

  • to identify the desired standards of ethics which should be operating in mediation
  • to identify the standards of ethics actually in operation in mediation practice generally, and in particular sectors
  • to examine the relevance of the difficulties posed by the confidentiality obligations under section 10 of the Mediation Act
  • to examine the relevance of the difficulties posed by the restrictions on the scope of a Mediator’s Court Report under section 17 of the Mediation Act
  • to identify possible suggestions for improvements in practice
    identify possible suggestions for amendments and legislation.
